Agreement to Terms

By accessing and using the services of PRC Building (ABN: 12 345 678 901), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.

Services

PRC Building provides professional building and construction services including but not limited to commercial building, residential construction, renovations, extensions, maintenance, and repairs. All services are subject to these terms and any additional terms agreed upon in writing.

Quotations

All quotations provided by PRC Building are:

• Valid for 30 days from the date of issue unless otherwise stated
• Subject to site inspection and may be adjusted if site conditions differ from initial assessment
• Exclusive of GST unless otherwise stated
• Based on the scope of work described and may change if project requirements change

Payment Terms

Standard payment terms include:

• Deposit: 10-30% deposit upon acceptance of quotation
• Progress payments: As agreed in the contract based on project milestones
• Final payment: Due within 7 days of project completion
• Late payments may incur interest charges at a rate of 2% per month

Project Timeline

While we strive to complete projects within the agreed timeframe, timelines are estimates and may be affected by factors including weather conditions, material availability, unforeseen site conditions, and variations to the scope of work. We will communicate any delays as soon as they become apparent.

Variations

Any changes to the agreed scope of work must be requested in writing and will be subject to a variation order. Variations may affect the project timeline and total cost. All variations must be approved and signed by both parties before work commences.

Warranties

We provide warranties on our workmanship as required by law and as specified in your contract. Manufacturer warranties apply to materials and equipment. Warranty claims must be made in writing within the warranty period.

Client Responsibilities

The client is responsible for:

• Providing accurate information about the project requirements
• Obtaining necessary permits and approvals (unless otherwise agreed)
• Ensuring site access for our team and equipment
• Protecting personal property and valuables during construction
• Making timely decisions on selections and approvals
• Ensuring payment is made according to agreed terms

Our Responsibilities

PRC Building commits to:

• Providing services in a professional and workmanlike manner
• Complying with all relevant building codes and regulations
• Maintaining appropriate insurance coverage
• Managing the site safely and minimizing disruption
• Communicating regularly about project progress
• Addressing any issues or concerns promptly

Liability

Our liability is limited to the value of the contract. We are not liable for indirect or consequential losses. Our insurance covers public liability and workers' compensation as required by law.

Termination

Either party may terminate the contract in accordance with the terms specified in the written agreement. Early termination may result in fees for work completed and costs incurred.

Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good faith negotiation. If negotiation fails, disputes will be referred to mediation before any legal action is taken.

Intellectual Property

All designs, plans, and documents prepared by PRC Building remain our intellectual property unless otherwise agreed in writing. Clients may use these documents for the specific project only.

Privacy

We collect and handle personal information in accordance with our Privacy Policy and applicable privacy laws.

Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, pandemics, strikes, or government actions.

Governing Law

These terms are governed by the laws of the state/territory in which the services are provided.

Changes to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the revised date.
